At Native Adventures, we’re a family-run tour company that truly values every guest. Our goal is to make sure you have an unforgettable experience exploring Hawaiʻi. If something didn’t go as planned, we’ll do our best to make it right. Instead of canceling, we encourage you to rebook for a future trip — it’s quick, easy, and gives you another chance to enjoy your adventure with us.

Cancellation made 72 hours or more before the scheduled tour will receive a full refund.
Cancellations made between 72 and 24 hours before the scheduled tour will receive a 50% refund.
Cancellations made within 24 hours of the scheduled tour or no-shows will receive no refund.

For any cancellation request to be valid, it must be submitted by email to loke@nativeadventureshawaii.com or by speaking directly with one of our live agents at 808-333-0663.
Please note: requests left on voicemail, sent via social media, or to any other email address will not be considered valid.

Assumption Of Risk & Liability Release

All participants in the packages, transportation, tours, and activities (“Experiences”) offered by Native Adventures LLC or its contracted vendors (“Native Adventures”) must understand and acknowledge that adventure activities, as well as travel itself, involve inherent risks. By purchasing this tour, you are bound by the acknowledgements stated below.

As a participant in many of our Experiences provided by contracted vendors, you may also be presented with a separate assumption of risk document from the vendor, which must be acknowledged before the Experience begins. The purpose of this document is to make all guests aware of what to expect and the potential risks involved.

Voluntary Participation

I understand and confirm that my participation in the Experiences is voluntary. I am in good health and do not suffer from any condition that would make me especially susceptible to injury or disability while participating.

Understanding The Risk

I fully comprehend and accept the risks associated with participation in the Experiences, including but not limited to:

• Risks inherent in adventure and outdoor activities (hiking, water sports, biking, boating, etc.).

• Transportation risks (car, bus, boat, kayak, paddleboard, bicycle, or on foot).

• Risk of injury from activities and use of equipment, including permanent disability or death.

• Falling, causing fractures, head, neck, or back injuries.

• Acts of nature: rockfall, weather changes, lightning, strong currents, waves, wind, heat, or cold.

• Equipment failure or malfunction.

• Negligence of Native Adventures or others, including contractors, vendors, or operators.

• Heat or cold-related injuries (sunburn, dehydration, heat stroke, hypothermia).

• Encounters with insects, animals, or wildlife.

• Illness or accidents in remote areas without immediate medical access.

• Fatigue, dizziness, or loss of balance that increases accident risk.

• Physical exertion for which I am not prepared.

• Emotional trauma, disfigurement, disability, or death.

• Food, water, or alcohol-related risks, including illness or impaired judgment.

• Criminal activity, unexpected events, or other conditions outside Native Adventures’ control.

I understand this list is not complete, and unknown or unanticipated risks may result in injury, illness, or death.

Risk Assumption

I assume all risks, known and unknown, connected with my participation in the Experiences. I accept personal responsibility for any liability, injury, loss, or damage connected with my participation, for myself and for anyone I am purchasing on behalf of.

Release of Liability & Limitation of Damages

I hereby release and discharge Native Adventures, its vendors, owners, employees, contractors, and representatives (“Released Entities”) from any and all claims, actions, damages, liabilities, losses, or expenses (including attorney’s fees) for death, injury, or property damage arising out of participation in the Experiences, including those caused by negligence.

Native Adventures’ liability is limited to actual damages arising from gross negligence or willful misconduct, and in no event shall exceed the total amount paid for the Experience. No liability exists for incidental, punitive, or consequential damages.

Indemnification

I agree to indemnify and hold harmless the Released Entities from any and all claims arising from my participation in the Experiences.

Binding Effect

This Waiver shall be binding on my heirs, representatives, and assigns, and shall inure to the benefit of Native Adventures, its successors, and assigns.

Consent to Medical Treatment

I authorize Native Adventures (or its vendors) to provide medical assistance, first aid, CPR, or emergency transport if deemed necessary. I acknowledge this does not impose a duty to provide such services.

Severability

If any provision of this Waiver is found invalid or unenforceable, the remaining provisions remain in full effect.

Promotional Release

I grant Native Adventures and its vendors the right to photograph, record, and use images or video of my participation in the Experiences for promotional and commercial purposes, without restriction or compensation. Native Adventures owns all rights to such materials.

THIS IS A WAIVER AND RELEASE OF LIABILITY. BY AGREEING TO THE TERMS AND CONDITIONS ON THE CHECKOUT PAGE, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THIS DOCUMENT AND AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS.

Participation by anyone under 18 years old indicates that a parent or legal guardian has consented to this Waiver on their behalf.
