Acknowledgement of Risk

I understand that participation in tours, activities, and transportation provided by Native Adventures LLC (“Native Adventures”) involves inherent risks. These risks include, but are not limited to:

  • Outdoor hazards such as uneven terrain, ocean currents, waves, and changing weather.

  • Physical exertion, slips, trips, and falls.

  • Encounters with insects, animals, and wildlife.

  • Transportation risks (vehicle, boat, kayak, paddleboard, bicycle, or on foot).

  • Equipment use, malfunction, or failure.

  • Remote locations where medical care may be delayed or unavailable.

I acknowledge that these activities may result in injury, illness, property damage, or death.

Voluntary Participation

I confirm that my participation is voluntary. I am in good health and do not suffer from any condition that would make me especially vulnerable to injury. I have disclosed any relevant medical conditions to Native Adventures.

Assumption of Risk

I knowingly and freely assume all risks, both known and unknown, associated with participation in Native Adventures’ tours and activities. I accept full responsibility for myself and for any minors or guests I book on behalf of.

Release of Liability

In consideration of being permitted to participate, I hereby release and discharge Native Adventures, its owners, employees, agents, contractors, and vendors (“Released Parties”) from any and all liability, claims, demands, actions, or damages arising out of participation in any Experience, whether caused by negligence or otherwise, except in cases of gross negligence or willful misconduct.

Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, or expenses (including attorney’s fees) arising from my participation in Native Adventures’ activities.

Medical Consent

I authorize Native Adventures to provide or obtain emergency medical treatment for me if necessary. I understand this does not create a duty to provide such treatment and that I am responsible for all costs of medical care.

Media Release

I grant Native Adventures the right to use photos, videos, or recordings of my participation for promotional purposes, unless I notify the company in writing before my activity.

Binding Agreement

This waiver is binding upon me, my heirs, executors, and assigns. Participation by anyone under 18 years of age requires the consent of a parent or legal guardian.

BY BOOKING OR PARTICIPATING IN ANY NATIVE ADVENTURES TOUR OR ACTIVITY, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THIS SAFETY & LIABILITY WAIVER.
