Native Adventures – Terms & Conditions

By booking or participating in any tour, package, or activity (“Experiences”) provided by Native Adventures LLC (“Native Adventures,” “we,” “our,” or “us”), you (“you,” “guest,” or “participant”) agree to the following Terms & Conditions. Please read them carefully before booking.

1. Bookings & Payments

  • All bookings are subject to availability and confirmed upon receipt of payment.

  • Payment in full is required at the time of booking unless otherwise stated.

  • We accept payments in U.S. Dollars (USD) through approved methods (credit card, debit card, or other options listed at checkout).

  • You are responsible for providing accurate information when booking.

2. Cancellations & Refunds

  • All cancellation requests must be submitted by email to loke@nativeadventures.com.

  • Requests made via voicemail, social media, or to any other email will not be considered valid.

  • Refunds will be processed in accordance with our Refund & Cancellation Policy. Please review that policy before booking.

3. Pricing & Availability

  • All prices are listed in U.S. Dollars (USD) and are subject to change without notice.

  • Prices are guaranteed once your booking is confirmed.

  • Tour inclusions (transportation, meals, entry fees, etc.) will be clearly stated at the time of booking. Anything not specifically listed is the guest’s responsibility.

4. Assumption of Risk

  • By participating in our Experiences, you acknowledge that adventure activities involve inherent risks, including but not limited to: outdoor conditions, wildlife, transportation, and weather.

  • You voluntarily assume all risks associated with participation, whether known or unknown.

5. Liability Release

  • Native Adventures, its employees, agents, vendors, and contractors are not responsible for any injury, loss, damage, or delay resulting from participation in our Experiences, except in cases of gross negligence or willful misconduct.

  • We are not responsible for the acts or omissions of third-party vendors.

6. Guest Responsibilities

  • You must follow all safety instructions provided by our guides or vendors.

  • You are responsible for arriving on time for your scheduled Experience. Late arrivals may result in forfeiture without refund.

  • You must disclose any medical conditions or limitations that could affect participation.

  • Native Adventures reserves the right to refuse service to anyone under the influence of drugs or alcohol, or whose behavior poses a safety risk.

7. Force Majeure

We are not liable for cancellations, delays, or changes caused by circumstances beyond our control, including but not limited to: severe weather, natural disasters, pandemics, strikes, civil unrest, or government actions.

8. Intellectual Property

All content on the Native Adventures website, including logos, text, photos, and videos, is the property of Native Adventures and may not be copied, distributed, or used without permission.

9. Media & Promotional Use

By participating in our Experiences, you grant Native Adventures the right to use photographs, videos, and audio recordings taken during tours for promotional and marketing purposes, unless you notify us in writing before the Experience.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of Hawaiʻi and the United States. Any disputes shall be resolved in the appropriate courts located in Hawaiʻi.

11. Amendments

Native Adventures reserves the right to update or modify these Terms & Conditions at any time. Any changes will be posted on our website with an updated “Last Updated” date.
